1. Scope of Application
These Terms & Conditions apply to all orders placed by consumers through the NAUTEC online shop at: www.dive-nautec.com
The online shop is intended exclusively for consumers. A consumer is any natural person who enters into a legal transaction for purposes that are primarily outside their commercial or independent professional activities. These Terms & Conditions define the rights and obligations between NAUTEC and the customer in connection with the purchase of products through the online shop. Any conflicting terms or conditions provided by the customer shall not apply unless expressly accepted by NAUTEC.

3. Products and Product Information
NAUTEC develops and supplies high-quality technical components for diving applications. All product descriptions, technical specifications, images and other information provided in the online shop are prepared with the greatest possible care and are intended to describe the products. NAUTEC reserves the right to make technical improvements, design modifications or product updates, provided that such changes do not materially alter essential characteristics of the ordered product. Product information does not replace the applicable safety instructions, installation instructions, maintenance requirements or operating instructions.
4. Conclusion of Contract
The presentation of products in the online shop does not constitute a legally binding offer, but an invitation for the customer to submit a binding purchase offer. By completing the ordering process and submitting the order, the customer submits a binding offer to purchase the selected products. Receipt of the order will be confirmed automatically by e-mail. This automatic confirmation only confirms receipt of the order and does not constitute acceptance of the purchase contract. The contract is concluded when NAUTEC: expressly confirms acceptance of the order, or ships the ordered products. If an ordered product is exceptionally unavailable, NAUTEC will inform the customer without undue delay.
5. Contract Language and Communication
The contract language is English. Since the NAUTEC online shop is operated internationally and provided in English, communication with customers will generally take place in English. The customer is responsible for providing a correct and accessible e-mail address through which NAUTEC can communicate regarding the order.
6. Prices and Taxes
All prices displayed in the NAUTEC online shop are provided in accordance with applicable legal requirements. The total price, including any applicable taxes, shipping costs and additional charges, will be clearly displayed before the customer completes the order. For deliveries outside the European Union, additional costs may apply, including:
import duties,
import taxes,
customs clearance fees,
other governmental charges.
Such costs are not charged by NAUTEC and shall be borne by the customer unless otherwise stated during the ordering process. The customer is responsible for informing themselves about the import regulations applicable in their country of residence.
7. Payment Terms
The available payment methods are displayed during the ordering process. Currently offered payment methods include:
bank transfer, credit card payment via Stripe. When selecting a payment method provided by an external payment service provider, payment data processing is carried out according to the privacy policies of the respective service provider. The purchase price becomes due according to the payment terms displayed during the ordering process. NAUTEC reserves the right to exclude certain payment methods in individual cases where there is a legitimate reason.
8. Delivery
Delivery is made to the shipping address provided by the customer during the ordering process. NAUTEC ships products within the European Union and worldwide to countries available as delivery destinations in the online shop. Shipping is carried out through suitable logistics partners. For international shipments, NAUTEC uses established transport providers, including:

TNT
Unless otherwise agreed, NAUTEC selects the appropriate shipping provider.
9. Delivery Times
Any delivery times stated in the online shop are estimated delivery times. As NAUTEC supplies technical specialty products, delivery times may be affected by various factors, including:
international transportation routes, availability of components, logistics processes, customs procedures, events beyond the reasonable control of NAUTEC. If significant delays occur, NAUTEC will inform the customer. The customer’s statutory rights in case of delivery delays remain unaffected.
10. International Shipping
For international deliveries, the shipment may be affected by customs authorities, local regulations or transport service providers.
The customer is responsible for:
providing a complete and accurate delivery address,
complying with local import regulations,
paying any applicable import duties and taxes.
NAUTEC is not responsible for delays caused by customs procedures or governmental measures in the destination country.
11. Retention of Title
The delivered products remain the property of NAUTEC until full payment of the purchase price has been received.
12. Right of Withdrawal
Consumers have the statutory right of withdrawal. Details regarding the withdrawal period, the exercise of the right of withdrawal, and the consequences of withdrawal are provided in the separate Withdrawal Information made available by NAUTEC. The Withdrawal Information and the model withdrawal form are provided to customers in accordance with applicable consumer protection requirements.
13. Warranty and Statutory Consumer Rights
All products supplied by NAUTEC are subject to the statutory consumer warranty rights applicable under German law. In the event of a defective product, the customer is entitled to the statutory remedies, including repair or replacement, withdrawal from the contract, price reduction or compensation, where applicable. NAUTEC recommends that customers notify us of any apparent defects or transport damage as soon as reasonably possible. Such notification is not a prerequisite for exercising statutory rights.
14. Product Safety and Intended Use
The products supplied by NAUTEC are precision-engineered technical products intended for diving applications. Safe operation requires that all products are used exclusively within their intended purpose and in accordance with:
product information,
safety instructions,
installation requirements,
maintenance instructions,
and applicable technical guidelines.
Customers must not use products outside their specified technical limitations. Before every use, products must be inspected to ensure they are in proper working condition. Damaged, modified or improperly functioning products must not be used.
15. Maintenance, Repairs and Technical Modifications
For safety reasons, maintenance and repair work on NAUTEC products should only be performed by NAUTEC or by an Authorized NAUTEC Service Partner. Unauthorized disassembly, repairs, modifications or technical alterations may significantly affect product safety and performance and may result in serious injury or life-threatening situations.
Damage or defects caused by:
unauthorized repairs,
improper maintenance,
technical modifications,
tampering,
or the use of non-approved components,
are excluded from warranty coverage to the extent that such damage was caused by these actions. Mandatory statutory consumer rights remain unaffected.
16. Original-NAUTEC Spare Parts and Original-NAUTEC Service Kits
To maintain product quality, safety and reliability, NAUTEC recommends using only:
Original-NAUTEC Spare Parts and Original-NAUTEC Service Kits for the maintenance and repair of NAUTEC products. The use of non-approved spare parts or components may affect product function, safety and service life. Maintenance and repair work should only be performed using suitable components that comply with NAUTEC technical specifications.
17. Liability
NAUTEC shall be liable without limitation for damages caused intentionally or through gross negligence. In cases of slight negligence, NAUTEC shall only be liable for the foreseeable damage typically arising from the breach of essential contractual obligations. Essential contractual obligations are obligations whose fulfilment is necessary for the proper performance of the contract and on whose compliance the customer may reasonably rely. The limitations of liability shall not apply in cases involving:
injury to life, body or health,
claims under applicable product liability laws,
expressly granted guarantees, or any liability that cannot be excluded or limited by law.
18. Intellectual Property
All content provided in the NAUTEC online shop, including but not limited to:
product descriptions,
technical information,
photographs,
graphics,
drawings,
logos,
trademarks,
texts and documentation,
is protected by copyright, trademark rights or other intellectual property rights. Any use, reproduction, modification, distribution or exploitation of such content beyond the limits permitted by law requires prior written approval from NAUTEC or the respective rights holder.
19. Privacy
Information regarding the processing of personal data by NAUTEC is provided in the separate Privacy Policy available on the website.
The Privacy Policy provides information regarding:
the types of personal data processed,
purposes of processing,
service providers involved,
legal bases for processing,
and the rights of data subjects.
20. Consumer Dispute Resolution
NAUTEC is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration body unless legally required to do so.
21. Applicable Law
The laws of the Federal Republic of Germany shall apply. For consumers, this choice of law shall only apply to the extent that it does not deprive the consumer of mandatory legal protections granted by the laws of the country where the consumer has their habitual residence. The United Nations Convention on Contracts for the International Sale of Goods (CISG) shall not apply.
22. Final Provisions
If any provision of these Terms & Conditions is or becomes invalid or unenforceable, the validity of the remaining provisions shall remain unaffected. The invalid or unenforceable provision shall be replaced by the applicable statutory provisions.
